Why did I receive a ticket in a free parking space?

The car park where you received your ticket is actually privately owned and has been made available to customers for free use, subject to the parking regulations in force there.

This states that the vehicle may only be parked there with a valid parking disc and within a parking period specified by the owner.

In the event of an infringement, our company will determine the infringement as part of regular checks, document it photographically and send a ticket to the vehicle with a request to pay a specified contractual penalty.

Do I have to pay for the ticket? What happens if I don't pay?

In principle, contrary to the locally valid parking regulations on private property, the parking process is a prohibited self-authority, which obliges the driver of the vehicle to pay a contractual penalty.

After the expiry of the reminder period, we will, if necessary, forward the process to a debt collection agency.

I didn't see any indication of a parking disc requirement!

In principle, there must be at least one visible sign at each entrance, on which the framework conditions for free parking, i.e. the parking disc and the maximum parking time, are clearly visible at first glance. In addition, the consequence of non-compliance, i.e. the contractual penalty, must be clearly recognizable.

Of course, we are happy to meet all these requirements by not only increasing the parking time and the contractual penalty next to the parking disc, but also highlighting it in color.

In addition, there are usually other signs in the parking lot that indicate that parking discs are mandatory.

I was only gone for a few minutes, is there a time limit?

Checks are carried out daily by various employees at irregular intervals. It is not possible to determine whether a vehicle has only recently been parked without a parking disc or whether it has been parked for a longer period of time, simply because the only objective control instrument, the parking disc, is missing.

In the context of treating everyone equally, it is therefore only fair to rate every vehicle equally.

Did the public order office issue me the ticket? Whom can I contact?

 

No, the parking space on private property, unlike public spaces, is often controlled by a private company on behalf of the owner.

This control is not subject to the regulatory office.

Why does the contractual penalty differ from the usual fine in public parking lots?

The amount of the contractual penalty on private property is not based 1:1 on the catalog of fines. According to general legal opinion, the value of the contractual penalty assessed on private property may differ significantly, but must be clearly shown on the signs.

 

Couldn't the field service on site process my inquiries?

The field service employee on site is only responsible for determining and recording the respective parking violation and its transmission. This does not include data processing or post-processing in his area of ​​responsibility. After the ticket has been issued or the case-related data has been sent (photographic evidence such as intended use), processing is only possible in the back office upon request.

 

Is the content of the ticket sufficient?

Of course, the content meets all legal requirements.

Why is it important to state the intended purpose when making a transfer?

Due to the large number of parking spaces to be checked, it is not possible to allocate individual transfers without a purpose. This shows, among other things, the place, date and license plate number. So that the properly paid tickets (and the associated data) can be deleted and not accidentally given a reminder, we need as complete a purpose as possible.

 

What happens to the photos? Isn't that my data?

In principle, of course, we meet all the requirements of data protection laws.

We only take photos in public places, taking care not to capture any details that are "unnecessary" for the process, such as people or other vehicles. In principle, we do not collect any personal data on site, the data used is only archived for the duration of the processing under high security aspects.

How can you prove that I really parked without a parking disc or with an expired parking disc?

In principle, several photos are taken of each parking violation, and the parking violation is created from different perspectives (including the exact time and GPS information). Furthermore, a photo of the ticket handover to the vehicle is taken. If the parking time is violated, the parking disc is also photographed in detail.
